Literary digitizing legal aspects

Abstract

Bakalaura darbā aplūkoti ar literāro darbu digitalizēšanu un tās rezultātu publiskošanu saistītie juridiskie jautājumi. Par pamatjautājumu, uzskatāms tas, vai uz digitalizētiem literārajiem darbiem attiecināmais regulējums ir identisks normām, kas attiecināmas uz papīra formāta izdevumiem. Viens no darba mērķiem ir noskaidrot, vai ar literāro darbu digitalizēšanu saistītās tiesību normas nodrošina efektīvu un modernajai pasaulei atbilstošu informācijas aprites kārtību. Darba gaitā secināts, ka darbu digitalizēšanas jautājumos vēl nepastāv vienota tiesiskā prakse. Vienlaikus konstatēta sabiedrības interese par e-bibliotēkas izveidi, tomēr tā kā e-bibliotēku tiesiski nav iespējams pielīdzināt klasiskai bibliotēkai, juristu starpā pastāv diskusijas par to, vai un kā ar pastāvošo regulējumu iespējams nodrošināt šādu veidojumu pastāvēšanu.

In this bachelor thesis author explores legal aspects of digitising literal works and providing the society with the possibility to access the results. The main question is to understand if the legal frame for digitized books is identical to the frame that regulates any kind of actions with printed books. One of the aims of this paper is to analyse the legal basis for digitisation and to see if it is effective and complies with the demands of modern society. It is concluded that a unified legal practice in the field of digitisation has not developed yet. At the same time society wishes for e-libraries on-line. As it is not possible to equate completely an e-library with a traditional library, there are discussions among lawyers, if and how the existing legal frame allows the activities of an e-library to be carried out.
